A northwest Missouri prosecutor says he will not file criminal charges against a man who shot and killed his nephew during a domestic disturbance.

Nodaway County Prosecuting Attorney Robert Rice said Thursday that 51-year-old Lewis Schrodt was legally defending himself when he shot 34-year-old Mickey Lobdell of Kansas City at a home near Hopkins last December.

The St. Joseph News-Press reports investigators determined Schrodt fired two warning shots before shooting Lobdell, who was threatening him and other family members.

Rice said Schrodt was not physically capable of defending himself against Lobdell.
