A grand jury has indicted 33 year-old Damien Fugate on Involuntary Manslaughter charges.The indictment was handed down Wednesday in Marion County Circuit Court.

Fugate, an employee of Hardees in Hannibal, became involved in a physical altercation March 24th with a customer who was reportedly abusive to employees and patrons at the restaurant. The customer, 43 year old Gregory Stanley of Vidor, Texas, suffered serious injuries and was first taken to Hannibal Regional Hospital and later transferred to Blessing, where he died from his injuries.

Fugate was first charged with assault before the charges were upgraded to Involuntary Manslaughter. Fugate is scheduled for arraignment May 6.
