It could be next year before a Hannibal man stands trial in the death of a Marion County woman and the shooting of her husband two years ago.
36 year old Timothy Brokes was in Marion County Circuit Court Wednesday.

Brokes has pleaded not guilty to first degree murder and armed criminal action in the death of Brittany Gauch and first degree assault and armed criminal action in the shooting of Aaron Gaugh on January 18th, 2016.

When Brokes was arrested, he is alleged to have waived his Miranda rights before talking with a detective. Brokes later had a conversation with his attorney. Apparently, both conversations were recorded by law enforcement officials.

Brokes’ attorney maintains that this makes the entire video, which allegedly contains a confession, inadmissible in court.

Judge Rachel Bringer Shepherd said in court that she would not rule on the case until a similar case is ruled on the Missouri Supreme Court.

Another hearing in the case is set for March 26th.

Meanwhile, Brokes is set to stand trial in Monroe County for the shooting of a Monroe City Police officer June 12th.
