A Hannibal man facing charges in the death of a Hannibal woman in early 2016 was in court Monday.
Marion County Prosecuting Attorney David Clayton says Timothy Brokes appeared on charges related to the death of Britney Gauch and for allegedly shooting and running over Timothy Gauch in Marion County and in the shooting of Monroe City Police Officer Travis Pugh in January of 2016.  Clayton says a change of venue motion is being taken under advisement as are previously filed motions to suppress defendant statements and evidence collected in the investigation.

Monday’s hearing focused on the search of the 1104 Summer Street Hannibal address, the collection of evidence inside the residence, and a search of the Bel Air Motel in Monroe City. Prosecutor David Clayton filed a motion to overrule the defense motions on the basis that the defendant lacked legal standing, or right, to claim any alleged 4th amendment violations because he had no expectation of privacy in the Gauch residence. That motion was also taken under advisement by the Court. Clayton maintains that there were no violations of defendant’s rights during the search of the Summer Street residence. Monroe County Prosecutor Talley Kendrick says no violations of defendant’s rights occurred at the search of the Monroe City motel.
