Dustin Dye Appeals Child Abuse Conviction
Attorneys for a Hannibal man have filed an appeal of his child abuse conviction last summer.
Dustin Dye filed an appeal request in the Eastern District Appellate Court.
A jury found Dye guilty of felony child abuse on August 11th. Dye is alleged to have seriously injured his girlfriend’s seven-month-old daughter, known in news reports as Baby Nora.
The appeal alleges that Dye’s rights to due process and a unanimous jury verdict were violated through what is known as a plain error standard, related to jury instructions before they began deliberations.
The appeal is scheduled to be heard March 1st.
Dye remains in a Missouri Department of Corrections facility.
