Four of the five motions made by the state in the retrial of Curtis Lovelace were granted at a pre-trial hearing Tuesday.

At the hearing in Cass County Court in Virginia, Judge Bob Hardwick ruled that Lovelace’s second wife, Erika Gomez, will be allowed to testify, and allegations that Lovelace abused Gomez will be allowed as evidence. Claims that Lovelace poisoned Gomez will not be heard by the jury in the case.

Judge Hardwick said he will wait to rule on whether Lovelace’s computer can be used as evidence in the trial.

The first degree murder retrial of Curtis Lovelace for the 2006 death of his first wife, Cory Lovelace, will take place in Sangamon County on a change of venue. The first trial a year ago resulted in a hung jury.
